OK, in my previous entry I referred to a new Facebook group I've created.

I used the only picture available at work, which is the one on this entry.

However, I obviously want to use a more TP related one.

I've found a good shot I took of him at the 2004 Con wearing the spider-web cloak. I've cropped others out of it but I'm not sure of the legal position with regard to putting it up on a website. I suppose as others put thier photos up it will be Ok, but there again they are putting them up on sites that have limited visibility, unlike Facebook.

Any thoughts?

As we're not American providing you don't pass anyone off as holding an opinion in the photo (i.e. don't label it "We love $foo and buy it every day") you have no legal concerns. You took the photo - you have rights to it's usage. Tbh Pterry is about the only person who'd actually stand a chance of claiming you mis-represented him anyway so I'd be pretty confident.

I think that so long as you're not trying to pass yourself off as him you'll be fine.

Worst could happen: he could ask you to take it down and replace it!
